Le Ouipette versus Whippet

A chocolate store in Sherbrooke has been forced to rename one of its more popular offerings.  Choco-la was selling a confection featuring a shortbread cookie topped with marshmallow and caramel covered by a chocolate coating.  The name:  Le Ouipette Deluxe.

That name - Le Ouipette - caught the ear of Dare Food, makers of the famous Whippet cookie line.  

After being contacted by the cookie company, the chocolate store was given 15 days to change its menus, signage and website, at a cost of three-thousand dollars.  

Now what was being called Le Ouipette is known as La Pouffette.  

The store owners say they're lucky their Christmas rush kept them from following through on a plan to order 10,000 boxes resembling the Whippet packaging.  

They have also changed the name of a chocolate they'd been calling a Turtle, for fear of attracting Nestle's attention.

    It's unfortunate for the company but it's hard to sympathize with these people as they seem to be clearly breaking copyright here. The fact they are changing the Turtle product seems to bear this out. They are probably fortunate they are not being sued as well.
